These are the Terms and Conditions governing the use of Alkile (including both the website alkile.app and the desktop software) and the agreement that operates between You and Alkile Labs. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions.

2. Modifications to the Software and Disclaimer of Warranty

Alkile provides tools that modify operating system configurations, registry settings, and hardware tuning (such as GPU/CPU offsets). By using these tools, You acknowledge and accept that:

• Hardware modifications, including overclocking or undervolting, carry inherent risks and may cause system instability, data loss, or physical degradation to components.
• Alkile Labs is not responsible for any damage to your hardware, software, or loss of data resulting from the use of the Performance Studio or System Tweaks.
• The Software is provided "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. Alkile Labs expressly disclaims all warranties, whether express, implied, statutory or otherwise.

3. Acceptable Use Policy

You agree not to use the Service to:

• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service or its related systems or networks.
• Reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Software.

4. Pricing and Subscriptions

Alkile offers both free and premium tiers. If you choose to upgrade to a Premium Subscription, you agree to pay all fees in accordance with the pricing terms presented to you at the time of purchase. All fees are non-refundable except as required by law or explicitly stated in our refund policy.

5. Intellectual Property

The Service and its original content (excluding Content provided by You), features and functionality are and will remain the exclusive property of Alkile Labs and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

6. Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Alkile Labs. Alkile Labs has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services (including advertisers such as Adsterra). You further acknowledge and agree that Alkile Labs shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

7. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of Alkile Labs and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 10 USD if You haven't purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall Alkile Labs or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.
